Elaine has extensive experience in dedicated intellectual property protection and enforcement and joined Amica Law LLC as an Associate Director in 2007. Before joining private practice in 2000, she was a Deputy Public Prosecutor and a State Counsel in the Attorney-General’s Chambers. With her unique litigation experience, she has assisted clients in the conduct and management of successful anti-piracy campaigns in Singapore in respect of a wide range of products, including toys, consumer electronics, apparel, cinematograph films, musical works, publications and sports wear and footwear.
In addition to assisting clients on contentious intellectual property matters, she has also managed and supervised the trade marks portfolios of clients, both locally and overseas, and assisted in the development of intellectual property protection and exploitation strategies for clients. She has also assisted in conducting IP due diligence, negotiating licence, franchise or assignment agreements, conducting searches and advising on the results of the searches as well as advising on contentious opposition and revocation actions involving both trade marks and patents. In addition, she has also advised clients on various IT and regulatory issues including on Internet domain name disputes, gambling or gaming laws in Singapore, privacy laws and the protection of confidential information in Singapore, and on product claims, labeling and advertising laws in Singapore particularly involving tobacco products, medicinal products, and cosmetics. Significant matters that she has been involved in include:
• Managing successful anti-piracy campaigns for major multi-national corporations
• Acting in trade mark and copyright infringement actions, including where applicable, applying for criminal search and seizure orders, interlocutory injunctions and pre-action discovery and/or interrogatory orders
• Acting in various copyright infringement actions involving a variety of works and subject matter including cinematograph films, artistic works, musical works and sound recordings available for download as wallpapers or ringtones for mobile phones
• Acting in registered design infringement actions in respect of jewellery designs
Elaine graduated from the National University of Singapore with an LLB (Hons) degree in 1996 and was called to the bar in 2000. She is a member of the Intellectual Property as well as the Information Technology Committees in the Law Society of Singapore. In addition, she has been listed as a recommended intellectual property lawyer in AsiaLaw Leading Lawyers (2006 and 2007) and Who’s Who Legal Trade Marks (2007).
